Terms and Conditions
1. The Contract Between Us
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us, we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.
2. Our Right to Refuse Your Order
2.1 Reasons for Refusal
We reserve the right to refuse to accept your order for any reason including, without limitation and whether or not payment has been received:
- 2.1.1 We have insufficient stock to deliver the goods you have ordered;
- 2.1.2 We do not deliver to your area;
- 2.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in pricing information from our suppliers.
2.2 Notification
If we do refuse your order, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to offer additional compensation for disappointment suffered.
3. Price
- 3.1 The prices payable for goods are as set out on our website.
- 3.2 You may be required to pay extra for delivery; delivery charges are set out on our website.
- 3.3 All orders are processed in USD at the displayed prices; conversions into other currencies are approximate and for convenience only.
4. Right for You to Cancel Your Contract
- 4.1 You may cancel your contract within fourteen working days from the day after you ordered.
- 4.2 To cancel, you must notify us in writing.
- 4.3 If you have received the goods before canceling, you must return them at your own cost.
- 4.4 Special order items can only be returned if faulty or delivered in error.
- 4.5 Any sums debited will be re-credited within 30 days.
- 4.6 Failure to return goods in proper condition may result in deduction of recovery costs.
5. Delivery of Goods
- 5.1 We will deliver the goods to the address you provide.
- 5.2 Delivery will be made as soon as possible and within 30 days.
- 5.3 Ownership transfers on delivery; goods held at your own risk thereafter.
6. Fraud Prevention
- 6.1 We may use personal information to conduct anti-fraud checks.
- 6.2 Information may be disclosed to credit reference or fraud prevention agencies; your credit rating will not be affected.
7. Notices
All notices from you to us must be in writing and sent to info@kiltmaster.com. Notices from us will be displayed on our website.
8. Events Beyond Our Control
We are not liable for failure or delay in delivery due to events beyond our reasonable control, including strikes, system breakdowns, floods, fire, or accidents.
9. Governing Law
The contract between us is governed by English law and disputes are subject to the jurisdiction of English courts.
10. Entire Agreement
These terms and conditions, along with website prices, delivery details, contact info, and privacy policy, constitute the entire agreement. No verbal statements by salespersons alter these terms.
